Background

On July 14, 2020, the Court Granted Plaintiff’s motion for summary adjudication (“MSA”) as to the issue of duty within the fourth cause of action. The Advancement Provision, which is at issue, states:

Notwithstanding any other provision herein referencing legal fees, in the event that any dispute arises related to this Agreement including if the dispute involves the Company, all of your legal fees will be paid by the Company regardless of the outcome of the dispute for your lifetime.
