DEMURRER TO PLAINTIFFS FIRST AMENDED COMPLAINT IS OVERRULED.

Background


This wrongful termination action arises from allegations relating to plaintiff David Wangs (Plaintiffs) employment with defendant Foot Locker Retail, Inc. (Defendant). Plaintiff alleges that Defendant wrongfully terminated Plaintiff from employment following Plaintiffs request for accommodations due to a physical disability and/or other health condition(s).

On May 15, 2018, Plaintiff filed the instant actions complaint (Complaint) alleging two causes of action for 1) disability discrimination, and 2) racial discrimination arising out of his May 11, 2017, termination by Defendant.

On August 26, 2019, Defendant removed the case to federal court on diversity grounds. Plaintiffs Motion for Remand was granted on the grounds that the one-year deadline to remove the matter had passed.
