Hammond v. Long Beach Community College District, et al.

The Motion for Summary Judgment, or in the Alternative Summary Adjudication, filed by Defendants Long Beach Community College District and Long Beach City College is DENIED. Defendant has not established it is entitled to judgment or adjudication of issues in its favor based on the undisputed material facts proffered. (Code Civ. Proc. § 437c)

In this action, Plaintiff Ethan Hammond, through his guardian ad litem Kimberly Hammond, alleges that on November 16, 2016, he was playing with other children in the upper section of the gym at Long Beach City College when his foot got caught in a gap between the mats and was subsequently injured. Plaintiff contends that the location, arrangement and condition of the mats constituted a dangerous condition. He asserts a claim for dangerous condition of public property against Defendants Long Beach Community College District and Long Beach City College.
