Defendant Aspen Skilled Healthcare Inc. and Kei-Ai Los Angeles Healthcare Center’s demurrer to the Complaint is OVERRULED.
On October 5, 2018, Plaintiff Sandra Nunez (“Plaintiff”) initiated the instant disability discrimination/wrongful termination suit against her former employer Defendant Aspen Skilled Healthcare Inc. and Kei-Ai Los Angeles Healthcare Center (“Defendants”) (sued as a single corporation and its dba). Plaintiff’s operative First Amended Complaint (“FAC”) alleges six causes of action for disability discrimination; 2) failure to provide reasonable accommodations; 3) failure to engage in a good faith interactive process;4) retaliation; 5) failure to prevent discrimination/retaliation; and 6) wrongful termination in violation of public policy.
Plaintiff alleges that she worked as a cook for Defendants from January 2018 to May 2018. On April 20, 2018, Plaintiff began to suffer from a uterine hemorrhage which limited her ability to work without an accommodation. On April 2
