This is an action for nuisance. According to the allegations of the complaint, plaintiffs Matthew and Brenda Wagoner (collectively, “Plaintiffs” or “the Wagoners”) own a residence at 2168 Hillstone Drive in San Jose. (See complaint, ¶ 1.) Defendants Ruth Mejorado aka Ruth Mia Burnias aka Burnias Perez aka Ruth Mia Perez (“Ruth”) and Mario Burnias (“Mario”) are the owners of property located across the street at 4824 Byington Drive. (See complaint, ¶¶ 2, 7.) Defendants Armando Saldana (“Saldana”), Jose Soto (“Soto”), and other unknown occupants are among at least 15 adults who have occupied the Byington Drive residence on a regular and continuous basis. (See complaint, ¶¶ 3, 8.) Defendants have consistently dumped beer bottles, condoms, toilet paper, garbage and other trash on the Wagoners’ and other neighbor’s properties, have regularly parked 10 or more cars on the street overnight and sometimes on the lawn of Defendants’ property, have made excessive noise, hosted a rave party attend
