RE: PLAINTIFFS’ REQUEST FOR FINAL RULING ON WRIT CLAIMS FOR
VIOLATIONS OF CEQA AND COASTAL ACT
The Court has read and considered the briefs filed by the parties on whether to issue a
ruling on Plaintiffs’ claims for violations of CEQA (2d cause of action) and the Coastal Act (3rd
cause of action). The Court finds that these claims are now moot.
In the first phase of the trial of this matter this Court resolved the title issue as to the 37
foot Walkway fronting Plaintiffs’ homes in favor of Plaintiffs, finding that neither the County
nor the public have any interest in, or rights to use the Walkway. This determination effectively
prevents the County from asserting that the Walkway had been dedicated for public use, which
