Motion to Compel Arbitration

Having considered the moving, opposing, and reply papers, the Court rules as follows.

BACKGROUND

On December 5, 2018, Plaintiff Justin Bennett (“Plaintiff”) filed a complaint against Defendants Uber Techonolgies, Inc, Rasier, LLC, Rasier-CA, LLC, and Ruslan Olayivola alleging negligent hiring, supervision, and retention, battery, assault, negligent infliction of emotional distress, and intentional infliction of emotional distress for an altercation that occurred on September 2, 2017.

On April 15, 2019, Plaintiff Justin Bennett filed a first amended complaint adding an additional cause of action for fraud.

On June 12, 2019, Defendants Uber Technologies, Inc., Rasier, LLC, and Rasier-CA, LLC filed a motion to compel arbitration pursuant to California Code of Civil Procedure section 1281.2.

Trial is set for June 3, 2020.
