Allegations of the Operative Complaint
Plaintiff Jane Doe D.M. (“Plaintiff”) brings this action against Defendant Dr. Patrick Mark Sutton, M.D., an obstetrician and gynecologist (“Dr. Sutton”), for his allegedly violent sexual acts that harmed and violated her while she was pregnant and giving birth to her first child. She alleges that she informed Dr. Sutton of her birth plan in October or November 2010, including instructions that she did not want an episiotomy (a surgical cutting of the perineum reserved for difficult vaginal births and to prevent rupture). (FAC, ¶¶24, 25(c).) Plaintiff alleges she went to her last pre-birth appointment on November 19, 2010 at Dr. Sutton’s Pasadena office alone and he stuck 2 fingers deep insider of her under
