Motion: Plaintiff’s Motion to Compel Further Responses to Requests
for Admissions, Set One, and Form Interrogatories – General,
Set One
Tentative Ruling:
To deny plaintiff’s motion to compel further responses to requests for admissions, set one, and form interrogatories – general, set one, for failure to adequately meet and confer in good faith before bringing the motion to compel, as well as procedural defects in the motion itself. (Code Civ. Proc. §§ 2030.300; 2033.290.) Explanation:
First, it does not appear that plaintiff’s counsel met and conferred in good faith before bringing the motion to compel. (Code Civ. Proc. §§ 2016.040; 2030.300 subd. (b); 2033.290, subd. (b).) “A meet and confer declaration in support of a motion shall state facts showing a reasonable and good faith attempt at an informal resolution of each issue presented by the motion.” (Code Civ. Proc., § 2016.040.)
