TENTATIVE RULING:
For the reasons set forth herein, the temporary restraining order issued by the court on January 15, 2015, is dissolved.
Background:
On January 12, 2015, plaintiff Marsha Zilles filed her complaint in this action for declaratory relief and injunctive relief regarding a pending foreclosure of property owned in part by plaintiff.
On January 15, 2015, plaintiff applied to the court ex parte for a temporary restraining order (TRO) to restrain an impending foreclosure sale.
The court granted the ex parte application and issued the TRO to expire, if not renewed, at 12:01 a.m. on January 28, 2015. The court also set this hearing on shortened time for January 28. By the court’s order, opposition was due on January 21 and reply due on January 23.
