Nature of Proceedings: Petition: Approval for Transfer of Payment Rights
TENTATIVE RULING: The petition will be granted.
Background: In 2010, the settlement of a wrongful death action resulted in Julia Muniz receiving a structured settlement consisting of monthly payments of $952.88 for life (increasing at 2% annually, from 11/1/11), guaranteed for 30 years. The action was solely for the wrongful death of Ms. Muniz’s father, who was killed in a wrong-way driver freeway accident with an employee of Verizon. Ms. Muniz was not in the vehicle, and her claim for wrongful death of her father was solely financial in nature; there are no future medical bills or other expenses that the settlement was intended to provide for. (Ms. Muniz’s young son, Izaiah Vega, also received a structured settlement, but he will receive no payments under that settlement until 2026.)
Ms. Muniz previously obtained court approval (Case # 1380748) for transfer of 120 payments of $375/month (from 7/11 through 7/21
