Nature of Proceedings: OSC TRO (DV)
This is a DV-109 [Domestic Violence] Notice of Hearing.
On 4/22/13 Kaylin Fox (“Fox”) filed a request for a TRO (Temporary Restraining Order) that Commissioner Motter had granted. The Commissioner’s decision to grant the Order appears to have been based on the DV-110 declaration of Fox wherein she stated, among other things: That Evangelatos shoved her to the ground; she ran for her car and locked herself in; he followed and proceeded to shake and hit her car; Fox called the police and an Emergency Protective Order was issued.
Evangelatos filed no response.
I could NOT find that the TRO was served on Evangelatos. There was no Proof of Service in the file. But on 5/10 Fox filed a request to continue the Court hearing and reissue the TRO.
When the case was called on 5/14 Evangelatos appeared with counsel, Alan Bifano; Fox did not appear, presumably because she had made the earlier request to continue the hearing.
