Nature of Proceedings: Motion: Return of Personal Property
Claimant Travis Lobo’s motion for return of personal property is denied. The petition for forfeiture will proceed on the merits. This is an action for forfeiture of personal property brought on behalf of plaintiff, the People of the State of California. The property at issue is a 45’ Panga boat with four Yamaha outboard motors that was seized by officers of the Santa Barbara County Sheriff’s Department on April 20, 2012, at Tajiguas Beach in Santa Barbara, California. Following seizure of the vessel, plaintiff initiated administrative forfeiture proceedings pursuant to Health & Safety Code Section 11469 et seq. Plaintiff alleges that the vessel is subject to forfeiture because it was used to smuggle illegal narcotics into the United States from Mexico.
