Ruling: The court grants, in part, defendant/cross-claimant Community West Bank’s motion for order appoint receiver and orders as follows: the court appoints Lindsay F. Nielson receiver of the real property located at 221 West Micheltorena Street, Santa Barbara, California to preserve, protect and maintain the property, to collect the rents, issues and profits from the property, and to pay the expenses associated with the property. The receiver shall not have the authority to transfer or dispose of the property. The receiver shall qualify upon taking the oath and posting an undertaking in the amount of $5,000. The court further orders that Mirzai may, on or before April 15, 2011, send or deliver to the tenants of the property a letter, in the exact wording set forth at page 3, lines 1-13 of his opposition. The receiver may communicate with the tenants on April 16 and thereafter. T
