Nature of Proceedings: Demurrer
This construction defect case involves the 235 unit Willow Springs apartment complex in Goleta, California. Plaintiffs allege two construction defect issues – problems with the bathtubs and sinks and problems with the hydronic heating system. In 2011, plaintiffs settled with the defendants involved with the bathtub and sink issues. The two remaining defendants are Environmental Heating and Air Conditioning, Inc. (“EHAC”), the installer of the hydronic heating system, and United Electric Company (“United”), the manufacturer of the hydronic heating coils. The only issues remaining to be tried relate to the hydronic heating system.
The operative complaint is plaintiffs’ fourth amended complaint (“FAC”) that was filed on January 5, 2012. The FAC added Willow Springs, L.P. (“Willow”) as a plaintiff.
