PLT Alfredo Hernandez; PLT Olivia Hernandez Motion - Other (Motion for Relief and Exemption from Electric Filing and Service)
The court grants Plaintiffs/ Judgment Creditors Alfredo and Olivia Hernandez Order for Relief from their late filed renewal of Judgment.
The court will deem the June 29, 2020 Application found as Exhibit E to the Declaration of Alexis Galindo as filed on May 24, 2020 nunc pro tunc. Plaintiffs filed the required documents April 1, 2020, but they were rejected for failing to pay the proper filing fee, incorrect calculations and markings, and the incorrect Judgment date.
Plaintiffs, however, was not given notice of these correctable mistakes until June 17, 2020, after the 10 year deadline to renew had passed on May 24, 2020.
Governor Gavin Newsom issued Executive Order N-33-20 (the “Stay at Home Order”) on March 19, 2020 which prompted the total and complete court closures from that date until May 26, 2020.
