Biography

Hon. Robert C. I. McBurney is a judge for the Fulton County Superior Court (5th Judicial Administrative District) in Georgia. He was appointed to the bench by former Governor Nathan Deal in February 2012.

During his judicial tenure, McBurney has presided on the Accountability Courts, which includes the Adult Drug, Behavioral Health Treatment, and Veterans Treatment Accountability Court Program. In addition, he served a two-year term as the Chief Judge of the Fulton County Superior Court beginning in 2018.

Among his notable cases on the bench, McBurney presided over a dispute between the children of the late Reverend Martin Luther King, Jr. regarding the ownership of his Bible and Nobel Peace Prize medal.

Prior to joining the judiciary, McBurney was an Assistant United States Attorney with the United States Attorney’s Office for the Northern District of Georgia, where he had worked since 2002. Before that, he served as an assistant district attorney with the Fulton County District Attorney’s Office, holding an assignment in the Major Felony Unit.

McBurney received an A.B. in political economy and development from Harvard College in 1990. He went on to complete a J.D. at Harvard Law School in 1995.
