                      Statement   ("Motion")    and the Court,    having heard the arguments ofcounsel           and reviewed

                     the file and being    otherwise   fully advised in the premises, finds       that, for the reasons stated

                      in open court,   it is

                              ORDERED        and ADJUDGED          as follows:

                               l.      The Motion     is GRANTED in part and DENIED              in part.

                              2.       The Motion     is GRANTED        with  respect   to Count   I for injunctive   relief and

                      Count   I is dismissed without     prejudice.

                              3.       The Motion     is GRANTED        with  respect   to Count   II for replevin   and Count

                      IIis dismissed with    prejudice.

                              4.       The Motion     is DENIED      with respect to Count      III for violation of the Trade

                      Secrets  Act.

                               5.      The Motion is granted      with respect to Count     IV for tortious interference     and

                       Count   IV   is dismissed     without    prejudice   to  Plaintiff   filing  an  amendment       pleading

                       sufficiently   identiffing   the  business relationships with       specific   persons   or  entities with

                       whom Plaintiff     alleges  Defendants tortiously      interfered.

                               6.       The   Motion   is DENIED      with respect   to Count    [V for breach    of the duty   of

                       loyalty.

                               7.       The Motion     is GRANTED        with  respect to Count    VI  for theft and Count     VI

                       is dismissed   with  prejudice.

                               8.       The Motion      is GRANTED        with   respect to Count      VII  for  civil theft  and

                       Count VII    is dismissed without     prejudice   to Plaintiff filing an amended     pleading   reflecting

                       compliance    with  the pre-suit notice    requirements    ofSec. 772.11,F\a.       Stat.
