BY PUBLICATIONS 3rd AMENDED ZOOM RULES AND STANDARDS COURT DECORUM Although court proceedings will be handled via Zoom, please adhere to courtroom decorum. Be mindful of your clothing and background. Go somewhere quiet without other people, activity, or distractions in the background. Consider using a Zoom background, which is a false background or wallpaper that covers your true surroundings. No eating, chewing gum or smoking. The Court will call the calendar as if we were in the courtroom, so please be on time. ZOOM PROCEDURES All parties must agree to proceed via ZOOM. You are getting this notice because you have already agreed to conduct your hearing via Zoom. If there was a misunderstanding and you now object, please notify the Court immediately. If you plan to submit evidence during the ZOOM meeting, both parties must agree to these Zoom procedures below: 1. If no more than 10 pages, the requirements are that you must upload your evidence in PDF form, email to the opposing party and to the Court prior to the hearing. For the Court, you must email only Ms. Alina Marshall, Case Manager, at amarshall@dekalbcountyga.gov. The evidence will not be reviewed prior to the hearing. 2. If more than 10 pages, documents should be placed in a drop box. Please share via email the drop box location. All evidence must be exchanged no less than 24 hours prior to the hearing. If you intend to present evidence to witnesses via Zoom, please be skilled on uploading the documents via Zoom’s shared screens. 3. Please note that these documents will not be automatically admitted into evidence during trial or the hearing. The same rules and procedures for admission of evidence applys. ZOOM SESSION If you are unfamiliar with Zoom, please go to www.Zoom.com and review their tutorial. You do not have to have a Zoom account to participate. All you need to do is to go to Zoom.com, press “Join Meeting” at the top of the screen, and type in the meeting id number. The session will then start.In some cases, you may have to download the Zoom application so do not wait until the last minute to open Zoom on your computer. When you first come into the online session, you will enter a waiting room. You will be unable to talk to other participants until the hearing begins. If you have any technical difficulty getting into the session, please immediately email Ms. Marshall at the address noted above. Record any efforts made to appear as your lack of participation may become an issue later. For those who do not have access to the internet and/or the technical abilities to access ZOOM, and would like to appear in person, must notify Ms. Marshall at amarshall@dekalbcountyga.gov, 5 days prior to this hearing. ZOOM EQUIPMENT Every participants must have his own device. No sharing. The device must have an operable camera and microphone. The Court will not conduct the hearing without being able to see all participants. If you are disruptive, the Court will conclude the session or remove you from the proceedings. Despite our new venue, you can still be held in contempt of court. COURT REPORTER / INTERPRETERS Parties are still responsible for contacting a court reporter if they want their hearing recorded and must advise the court reporter that the hearing will be conducted via ZOOM. Zoom does record but it will not be an official record; so, it does not preserve for appellate purposes! Just like in court, no party can record the Zoom session without permission. Please inform the Court if an interpreter is necessary. Note that the Georgia Supreme Court has authorized court reporters to take-down via Zoom and has allowed interpreters and witnesses to be sworn in remotely during the ZOOM hearing. CHAT FEATURES Note that there is a chat feature on Zoom. Please note that the Judge is not reading chat while conducting the hearing. The court’s staff will look at it and bring this information to the Court’s attention when appropriate. Sometimes it will be necessary for the Court to control who speaks and will thus mute everyone. If you wish to be heard, you will have to use the “raise your hand” feature. PUBLIC HEARINGS To conform to constitutional standards, the Zoom proceedings are considered open to the public. Hence, if others wish to watch the proceeding, it will be streamed live in Courtroom 5B or 5C of the DeKalb County Courthouse. This is a new experience and the Court requests your patience.
