IRE ME, the undersigned did personally appear the undersigned attorney, who, after being duly
sworn according to law, did depose and say as follows:
1 Tam an attorney at law licensed to practice law in the State of Florida. I am a member of the
Florida Bar Association, and am admitted to practice before all courts of the State of Florida. | am an attorney
with McCabe, Weisberg & Conway, LLC.
2. That McCabe, Weisberg & Conway, LLC is an attorney of record in the above-styled cause.
3. For routine uncontested foreclosure matters McCabe, Weisberg & Conway, LLC has agreed
to accept a flat fee of $3,450.00 ($3,625.00 for Freddie Mac cases and $2,250 for FHA/VA cases originated
before 12/31/2015 and $2,800.00 for FHA/VA cases originated after 1/1/2016). In the event that contested
issues arise during a foreclosure action, McCabe, Weisberg & Conway, LLC charges an additional hourly rate
of $215.00 and/or $225.00 and a flat rate of $250.00 for work relating to the contested issues.
4. Since McCabe, Weisberg & Conway, LLC, has agreed to accept the flat rate stated above, and
in consideration of the time and costs associated with keeping contemporaneous time records, McCabe,
Weisberg & Conway, LLC does not generate such time records for routine uncontested foreclosure matters.
However, in the course of handling a routine uncontested foreclosure action McCabe, Weisberg & Conway,
LLC performs the following actions:
(a). Examination of the title prior to initiating suit.
(b). Preparation of the Complaint, Lis Pendens, and Summons
(c). Preparation of Notice of Action and Affidavit of Diligent Search when appropriate.
(d). Re-examination of title from prior examination through recording of Lis Pendens to
check for intervening liens prior to seeking entry of Final Summary Judgment.
(e). Preparation of Request for Entry of Clerk’s Default.
(f. Examination of all case records in advance of preparing and filing a Motion for Final
Summary Judgment and hearing on same.
