NOTICE OF REQUIREMENT FOR CASE MANAGEMENT PLAN AND ORDER
THIS CASE (identified by the email Notice of Service of Court Documents)
came before the Court upon review of the Court's docket pursuant to In re:
Comprehensive COVID-19 Emergency Measures for Florida Trial Courts, Fla. Admin.
Order No. AOSC20-23 (Amendment 12) (April 13, 2021), and Ninth Judicial Circuit
Court Administrative Order No. 2021-04, and the Court finding that this Case is
appropriate for entry of a Case Management Plan and Order, it is hereby ORDERED:
1. Counsel and unrepresented parties shall immediately (a) review Ninth
Judicial Circuit Court Administrative Order 2021-04 (the "Case Management Admin
Order"), (b) meet and confer to identify whether this case shall proceed on a complex,
general or streamlined track and, (c) agree upon the terms and conditions of an
appropriate Case Management Plan in the form attached to the Case Management
Admin Order as Exhibit "C" (electronic copies of which may be found on the Ninth
Judicial Circuit website, Civil Case Management page).
2. Upon completion of the Agreed Case Management Plan and Order,
Plaintiff or Plaintiff's counsel shall be responsible for filing same in the Court file and
serving a copy to the presiding judge (via the judicial assistant) at the division email
address (available on the Court's website) with the proposed order for review. In the
event the parties are unable to agree on the terms of an appropriate Case Management
Plan and Order, the parties shall set the case for a case management conferencewith
the presiding judge.
3. The Agreed Case Management Plan shall be provided to the presiding
judge within thirty (30) days from the date of service of the complaint on the last of all
named defendants, or within thirty (30) days from the date of this order, whichever
occurs later.
4. SERVICE OF THIS ORDER: Counsel is ordered to promptly serve and
file proof with the Clerk, no more than five (5) business days from the date of this Order

that all prose parties, subsequently named or appearing herein, have been served
copies of this Order. In the event a party is unrepresented and has not designated an
email address for purposes of electronic service, counsel for Plaintiff shall be
responsible for serving this Order and all future orders of the Court via a non-electronic
means (U.S. mail, Federal Express or the equivalent) and shall file a Certificate of
Service with the Court indicating who was served, the date of service, and the method
of service (including any address or email used) within three (3) business days. If
Plaintiff is unrepresented, Counsel for the Defendant shall have this same obligation. If
all parties are unrepresented, the Plaintiff shall provide stamped addressed envelopes
to the Court with submission of this and any other proposed Order.
5. CASES WHERE CASE MANAGEMENT PLAN AND ORDER NOT
REQUIRED: In the event this Notice was filed and served in a case in which (a) a
notice for trial has been filed and served but is not yet set for trial, (b) a Uniform Order
Setting Case for Jury Trial; Pre-Trial Conference and Requiring Pre-Trial Matters to be
Completed or other order setting the case for trial has been filed and served andwhich
is in force and effect, or (c) an order establishing case management deadlines has been
filed and served and which is in force and effect, then no case management plan and
order is required. For any reason set forth above, or for any other reason counsel may
determine that a case management plan and order should not be required, then
Plaintiff, if represented, or Defendant, if Plaintiff is self-represented, shall file a notice
and serve same to all parties and the presiding judge (in the same manner as set forth
above) setting forth the reason(s) why a case management plan and order is not
required.
DONE AND ORDERED in Orange/Osceola County, Florida, this 13th day of June,
