appeals to the Appellate Division of the Supreme Court of the State of New York, First Judicial
Department, from (a) the Judgment of the Supreme Court of the State of New York, New York
County (Ostrager, J) entered by the Clerk of the Court on May 13, 2019, and (b) so much of the
Decision and Order of the Supreme Court of the State of New York, New York County
(Ostrager, J.),dated December 20, 2018, and duly entered in the office of the Clerk of the Court
on or about December 21, 2018, upon which the Judgment was based that (i) adopted the

appraisal offered by expert witness as the fair value of Appel
concern, (ii) rejected the appraisal offered by Appellant's expert witness and,
