Munoz Case No: 21-CA-002881 Plaintiff vs Division: G B & D Towing & Recovery Inc. ; James David Pottorff Defendant CASE MANAGEMENT ORDER (Differentiated Case Management) This case comes before the Court pursuant to Florida Supreme Court Administrative Order AOSC21- 17, Amendment 1 and Thirteenth Judicial Circuit Administrative Order S-2021-060, Paragraph 12. The purpose of this Order is to notify the parties a Differentiated Case Management Order ("DCM Order") will be entered in this matter unless the case is set for trial or voluntarily dismissed. The DCM Order will establish case activity deadlines and project a trial date. The deadlines will be calculated based on the fact discovery deadline determined to be appropriate in this case. In making the determination, the Court will typically defer to the agreement of the parties. Accordingly, it is ORDERED and ADJUDGED that: 1. A DCM Order will be entered in this matter unless: A. Within 10 days of the date of this order, the case is scheduled for trial and a Uniform Order Setting Case for Trial and Pretrial has been entered; or B. Within 10 days of the date of this order, a Voluntary Dismissal is uploaded to the E-portal. 2. If the matter is not set for trial or voluntarily dismissed within 10 days of the date of this order, a notice of an agreed fact discovery deadline to be used in calculating deadlines in the DCM Order should be filed and emailed by the parties to the Division G DCM email address at DCM.CirCivDivG@fljud13.org. Please note this is not the email address to use when communicating with the judicial assistant. The sole function of the DCM.CirCivDivG@fljud13.org email address is to receive as-filed copies of the notice of an agreed fact discovery deadline for the Court’s use in entering the DCM Order. 3. If the matter is not set for trial or voluntarily dismissed, and if the parties do not submit a notice of an agreed fact discovery deadline, a fact discovery deadline will be selected by the Court and a DCM Order entered. 4. Plaintiff is directed to ensure a copy of this Order is provided to all parties.
