Defendants. / ORDER ON MOTION TO TRANSFER CAUSE TO COUNTY COURT THIS CAUSE was considered upon Defendant’s Ex Parte Motion to Transfer Cause to County Court from Small Claims Court in accordance with Florida Small Claims Rule 7.100(d), by which a Counterclaim was filed, which claim exceeds the jurisdiction of the Small Claims Rules, it is ORDERED and ADJUDGED as follows: 1. Defendant’s Answer and Counterclaim, for which Defendant was required to pay a filing fee, is treated as a Motion to Transfer the Small Claims case to County Court. This cause is hereby transferred to County Court upon payment of the difference between the County Court filing fee and the fee Defendant paid for the Counterclaim. 2. A County Court case number will thereupon be assigned. 3. If the moving party has not paid any further required amount within thirty days of the filing of this Order, then this Order shall be vacated automatically, and the moving party’s pleadings shall be deemed to seek telief not exceeding jurisdiction of the County Court.
