IN THE CIRCUIT COURT OF THE NINTH JUDICIAL CIRCUIT IN AND FOR OSCEOLA COUNTY, FLORIDA CASE NO.: 2018-CA-000388MF NEW PENN FINANCIAL LLC D/B/A SHELLPOINT MORTGAGE SERVICING, Plaintiff, vs. ADAN PEREZ, et al., Defendants. LE OV L2 Udy Qld? ORDER SETTING NON JURY TRIAL Based on the Court’s examination of the record and the representations of Counsel, the Court finds this case is ready for trial. Counsel who will try the case and pro se parties will appear for trial on the 20" day of June, 2018 at 9:00 AM; in Courtroom 5D of the Osceola County Courthouse, 2 Courthouse Square, Kissimmee, Florida. Counsel will confirm the hearing room or court room for the trial on the day prior to trial. 1, ATTENDANCE AT TRIAL. There will be no telephonic appearances at the trial. All appearances must be in person. Failure of a party to appear may result in Dismissal, Default, Judgment and/or Sanctions. 2. SETTLEMENT CONFERENCE. At least 20 days prior to the trial, Counsel for the parties will hold a telephonic settlement conference to discuss settlement. 3. DISCOVERY DEADLINE. All discoveries must be completed TEN days before the trial unless extended by the Court for good cause shown. 4. NOTICE TO COURT UPON SETTLEMENT. The parties will notify the Judge’s judicial assistant immediately via e-mail to ctjawb1@ocnjcc.org upon the case being settled. If a settlement is reached, the case will be dismissed and removed from the trial docket.5. SANCTIONS. Unexcused failure of counsel or unrepresented parties to engage in the telephonic settlement conference, or the trial or the failure to comply with the requirements of this Order will subject offending counsel or party to appropriate sanctions, which may include contempt, dismissal, default, striking of pleadings, or exclusion of evidence, assessment of fees or costs, and/or other sanctions. The Plaintiff will bring to the trial a proposed Final Judgment which sets a sale date with addressed/stamped envelopes for all parties. Plaintiff's counsel will arrange to have available at trial the Original Note and Mortgage as filed in the Court file. DONE AND ORDERED in Kissimmee, Florida, this AY day of April, 2018.
