IN THE CIRCUIT COURT, SEVENTH JUDICIAL CIRCUIT, IN AND FOR FLAGLER COUNTY, FL CASE NO.:2018 CA 000516 DIVISION:49 CRAIG PETERS Plaintiff, vs. CITY OF FLAGLER BEACH Defendant / ORDER SETTING JURY TRIAL, REQUIRING MEDIATION AND DIRECTING PRE-TRIAL PROCEDURE It appearing that this case is at issue and can be set for trial, it is ORDERED as follows: 1. TRIAL DATE AND CASE MANAGEMENT CONFERENCE. This case is set for jury trial during the two week period commencing 11/16/2020 at 9:00 a.m., in Courtroom No. 401, Kim C. Hammond Justice Center, 1769 E. Moody Blvd., Bldg. 1, Bunnell, Florida. The first date of the trial period is hereinafter referred to as the “trial date”. Case Management Conference (“CMC”) will be held in Courtroom #401, on 10/27/2020 at 9:00AM Appearance at CMC by counsel and all unrepresented parties is mandatory. FAILURE TO ATTEND CMC MAY RESULT IN DISMISSAL OF THE CASE. The specific date upon which trial will commence will be announced at CMC, and no additional notice shall be provided. NO MOTIONS WILL BE HEARD AT CMC. NO CONTINUANCE WILL BE GRANTED AT CMC. TELEPHONE APPEARANCE IS PERMITTED BY USING COURTCALL (888-882-6878). 2. PRETRIAL CONFERENCE. No pretrial conference will be scheduled unless requested in writing at least forty-five (45) days prior to the trial date. Please provide a copy of your request for a pretrial conference to the Judge’s Judicial Assistant so that one can be scheduled. 3. UNIFORM PRE-TRIAL PROCEDURE. The Uniform Pre-Trial Procedures can be found on the court’s web page at www.circuit7.org and shall govern all further proceedings. 4. FAMILIARITY WITH THIS ORDER. Counsel and all unrepresented parties shall read this Order and the attached Uniform Pretrial Procedures in Civil Actions, be familiar with its contents and comply with the requirements of both. Material non-compliance with this Order or the Uniform Pretrial Procedures in Civil Actions by counsel or any party will subject the offendingcounsel or parties to appropriate sanctions which may include, but are not limited to, contempt, dismissal, default, the striking of pleadings, claims or defenses, the exclusion of evidence or witnesses, the assessment of fees or costs, or such other sanctions as may be appropriate. 5. MEDIATION. Mediation shall be conducted no later than thirty (30) days before the CMC. The parties shall stipulate and agree to the mediator, as well as the time and location of the mediation conference. Jurisdiction is retained by this Court to appoint a mediator if the parties are unable to reach an agreement. The personal attendance of trial counsel and the parties is mandatory. The parties shall send an authorized representative with absolute authority to enter into a full and complete compromise and settlement. Ifa party fails to appear, or appears without settlement authority as required above, the Court has the right to impose appropriate sanctions against that party, including the taxing of costs, mediators fees and attorney fees for opposing counsel. The participants shall be prepared to spend as much time as necessary to settle the case or until an impasse is declared by the mediator. All discussions, representations and statements made at the mediation conference shall be privileged as settlement negotiations and shall not be admitted at trial or subject to discovery.
