THIS ACTION was heard before the Court on Plaintiff's Motion for Summary Judgment of
Foreclosure, equitable subordination, reformation of mortgage and Request for Attorneys’ Fees
on December 16, 2021, On the evidence presented,

and clear of all claims Defendants, with the exception of any assessments pursuant to Florida
Statues 718.116 and 720.3085.
3. If the total sum with interest at the rate described in Paragraph 1 and all costs accrued
subsequent to this judgment are not paid, the Clerk of Court shall sell the property at public sale
on Lebruarye g , 2022 to the highest bidder for cash, except as set forth in Paragraph 4,
IN THE LOBBY OF THE WASHINGTON COUNTY CLERK OF COURT, 1293 JACKSON
AVENUE, SUITE 101, CHIPLEY, FL 32428, AT 10:00 A.M. (CST) in accordance with § 45.031
Fla. Stat. (2019).
4, Plaintiff shall advance all subsequent costs of this action and shall be reimbursed for them
by the clerk if plaintiff is not the purchaser of the property for sale, provided, however, that the
purchaser of the property for sale shall be responsible for the documentary stamps payable on the
certificate of title. If the plaintiff is the purchaser, the clerk shall credit plaintiff's bid with the total
sum with interest and costs accruing subsequent to this judgment, or such part of it, as is necessary
to pay the bid in full.
5. On filing the certificate of title, the clerk shall distribute the proceeds of the sale, so far as
they are sufficient, by paying: first, all of plaintiff's costs; second, documentary stamps affixed to
the certificate; third, plaintiff's attorneys’ fees; fourth, the total sum due to plaintiff, less the items
paid, plus interest at the rate prescribed in paragraph 1 from this date to the date of the sale; and
by retaining any remaining amount pending the further order of this court.
6. On filing the certificate of sale, Defendant(s) and all persons claiming under or against
Defendant(s) since the filing of the notice of lis pendens shall be foreclosed of all estate or claim

7. Jurisdiction of this action is retained to enter further orders that are necessary or are proper
including, but not limited to, re-foreclosure against any subordinate interest omitted from these
proceedings, determining the amounts owed to any condominium or homeowners association, or
issuance of a writ of possession.
8. Count II- Equitable Subordination- The Court finds that the Plaintiffs’, U.S. BANK, N.A.,
AS TRUSTEE, SUCCESSOR IN INTEREST TO WACHOVIA BANK NATIONAL
ASSOCIATION, AS TRUSTEE, SUCCESSOR BY MERGER TO FIRST UNION NATIONAL
BANK AS TRUSTEE, FOR MID-STATE TRUST X, mortgage superior to all other liens and is
entitled to its count for equitable subordination. Specifically, this Court finds Plaintiff's lien
superior to the tax deed recorded in official records Book 1130 Page 508 of the public records of
Washington County, Florida, for Defendant, CAPITAL ONE NA AS COLL TLGF for the reasons
set forth in Plaintiff's complaint.
9. Count III- Reformation of Mortgage- The Court finds that, as a matter of law, the Plaintiff
may reform the mortgage to express the true intent of the parties. The legal description on the
mortgage recorded in the public records of Washington County at Official Records Book #388 at
Page #352 and subsequently corrected in Official Records Book 381 Page 54 is hereby reformed
to read:
