The 4/6/2021 CMO stated: "MEDIATION - Pursuant to the parties’ agreement to engage in private mediation, the parties are ordered and referred to mediation whic1/13/2022h shall be completed by 1/6/2022. A further CMC date is set for 1/13/2022 at 2:30 pm in Dept. 521 to confirm that mediation been completed. Failure to complete mediation without good cause may result in substantial sanctions and will not change the trial date." No party has confirmed completion of mediation and no party has filed a Case Management Statement. An Order to Show Cause is set for the first day of trial, Friday 4/8/2022 at 10:00 am in Dept. 521. as to why the parties should not have substantial sanctions - $750 per party - imposed for their failure to comply with the Trial Setting Order. Any response to the Order to Show Cause as to why the parties should not be sanctioned needs to be filed no later than four days before the trial date. Substantial monetary sanctions will be imposed unless this case has by that time been mediated before the 3/1/2022 Pre-Trial Settlement Conference or unless some other showing of good cause is made under oath as to why mediation was not completed as ordered by the Court. Andrew W Shalaby (Attorney) must forthwith serve a copy of this order on all counsel of record and self-represented parties, and file proof of service. Clerk is directed to serve endorsed-filed copies of this order, with proof of service, to counsel and to self-represented parties of record by mail. The Court orders counsel to obtain a copy of this order from the eCourt portal.
