COMPLAINT FOR BREACH OF CONTRACT
AND DEMAND FOR JURY TRIAL
COMES NOW the Plaintiff, DONNA BODNER (hereinafter "MS. BODNER’), by
and through the undersigned counsel, and hereby files her Complaint for Breach of
Contract and Demand for Jury Trial against the Defendant, TOWER HILL SELECT
INSURANCE COMPANY (“TOWER HILL”), and as grounds therefore, state as follows:
GENERAL ALLEGATIONS
1. The amount in controversy in this action exceeds the sum of Fifteen
Thousand and 00/100 ($15,000.00) Dollars, exclusive of pre-judgment interest, court
costs and attorney's fees.
2. At all times relevant hereto, MS. BODNER, was and is the owner of the
insured property located at 410 E. Beach Street, Panama City, Bay County, Florida and
as such this Court has proper jurisdiction.
3. Upon information and belief, at all times relevant hereto, TOWER HILL is
and was a Florida Corporation doing business in the State of Florida, including Bay
County.

carrier by the State of Florida to engage in the business of insurance with the Plaintiff.
5. TOWER HILL, while engaging in the business of insurance in the State of
Florida, is required to follow and/or comply with all Florida Insurance Code Statutes and
regulations promulgated by the legislature and the Florida Department of Financial
Services.
6. In consideration of the premium paid to it by the MS. BODNER, TOWER
HILL issued to the MS. BODNER in Bay County, Florida, a Homeowners policy, Renewal
Policy No. H003714354 (hereinafter referred to as “The Policy”), which was in full force
and effect (effective dates December 23, 2017 to December 27, 2018) at the time the
damage occurred as a result of Hurricane Michael and/or hurricane-force winds, and
ensuing damages that occurred on or about October 10, 2018. MS. BODNER has
attached as Exhibit “A” the evidence of The Policy in her possession; a certified copy of
The Policy is herein requested.
7. Damages from substantial wind damage, and ensuing damages as a direct
result thereof, are covered damages under The Policy.
8. MS. BODNER timely reported her damage to TOWER HILL, and opened a
claim pursuant to the terms and conditions of The Policy.
9. In response, TOWER HILL assigned the claim to its representative, Jessica
Sickler, to adjust and investigate the loss.
10. Onor about October 17, 2018, nothwithstanding the substantial damage to
MS. BODNER’S home, TOWER HILL only tendered undisputed insurance benefits in the
amount of $5,000.00; therefor TOWER HILL acknowledged coverage. (See attached
T2385291.DOCX;1Exhibit “B”).
11. In an effort to mitigate her damages, MS. BODNER retained the services of
Safeway Restoration to perform water mitigation and mold remediation services. MS.
BODNER incurred out-of-pocket costs in the total amount of $43,196.71, for Safeway
Restoration’s services. (See attached composite Exhibit “C”).
12. On or about January 7, 2019, TOWER HILL estimated MS. BODNER’S
damages totaled only $74,599.60, and after depreciation ($16,556.91) and policy
deductible ($6,440.00), undisputed insurance benefits in the amount $51,602.69, would
be tendered. (See attached Exhibit “D”).
13. On or about February 26, 2019, concerned that TOWER HILL had no
intention to thoroughly investigate the full extent and nature of the damages, MS.
BODNER retained the services of insurance claim professional, Sentry Public Adjusting,
to assist in submitting her claim to TOWER HILL which would adequately and objectively
detail all the damages sustained as a result of the loss.
14. On or about May 7, 2019, MS. BODNER provided TOWER HILL with her
estimate of damages in the total amount of $269,405.48 (Coverage A Dwelling). (See
attached Exhibit “E”).
15. On or about May 9, 2019, MS. BODNER provided TOWER HILL with her
executed Demand Package and Sworn Statement in Proof of Loss in the total amount of
$269,405.48. (See attached Exhibit “F”).
16. TOWER HIll then retained one of its preferred vendors, Neil Weghorst, P.E.
of U.S. Forensic, LLC, to inspect the insured property to determine the extent of damage.
On or about July 30, 2019, Neil Weghorst, P.E. of U.S. Forensic, LLC, inspected the

17. Todate, TOWER HILL has failed and/or refused to tender any supplemental
dwelling insurance benefits to MS. BODNER.
18. MS. BODNER has provided TOWER HILL with all requested
documentation and/or information needed TOWER HILL to tender owed insurance
benefits.
19. MS. BODNER has provided TOWER HILL with access to the insured
property so that it may have inspected all claimed damages.
20. Upon information and belief, TOWER HILL used preferred vendor(s) in its
investigation of the loss.
21. TOWER HILL is contractually and statutorily required to timely tender owed
insurance benefits.
22. MS. BODNER has cooperated with all reasonable and relevant requests
made by TOWER HILL in its investigation of the loss.
23. TOWER HILL’S denial was a wrongful material breach of The Policy. A
material breach by one party excuses the other party from further performance under the
contract. Insurance contracts follow this general principle from the maxim that "the law
does not compel a man to do a useless act." In the context of insurance contracts, a
coverage denial waives an insured's duty to comply with contract conditions precedent
such as submission to execution of repair contracts, submit to examinations, satisfaction
of proof of loss requirements, loss payment provisions, notice, and other contract
requirements.
T2385291.DOCX;124. Where a contract vests a party with discretion, but provides no standards
for exercising discretion, Florida law requires that the party exercise that discretion in a
reasonable manner.

(BREACH OF CONTRACT)
25. MS. BODNER re-alleges Paragraph No.’s 1-24 as if fully set forth herein.
26. Onor about October 10, 2018, MS. BODNER’S insured property sustained
substantial wind damage as a result of severe storm, and ensuing damages.
27. TOWER HILL sent and/or assigned insurance adjusters and/or
representative, to investigate and provide a coverage opinion, and evaluate the extent
and nature of the claimed damages.
28. MS.BODNER suffered a loss regarding her insured property and continues
to suffer the loss.
29. TOWER HILL’S obligation to tender owed insurance benefits is continuing
in nature. A party's ongoing nonperformance constitutes a continuing breach while the
contract remains in effect.
30. TOWER HILL’S breach is a continuing breach of The Policy.
31. TOWER HILL has failed and/or refused to tender all owed insurance
proceeds, undisputed or otherwise, to MS. BODNER that are due and owing to MS.
BODNER.
32. MS. BODNER has requested that TOWER HILL pay her damages; TOWER
HILL has failed and/or refused, and continues to refuse to pay the full damages despite
knowing it is required to do so.
33. MS. BODNER has done and performed all those matters and things
T2385291.DOCX;1properly required of it under The Policy, or alternatively, has been excused from
performance of the acts, representations, omissions, and/or conduct of TOWER HILL.
34. Notwithstanding the foregoing, TOWER HILL has failed and/or refused to
provide full coverage under The Policy for the damages to MS. BODNER’S insured
property TOWER HILL has failed to promptly pay all the amounts due and has thereby
breached its contract of insurance.
35. Asa direct result of TOWER HILL’S breach of its insurance contract, MS.
BODNER has lost benefits of her insured property, and continues to suffer the loss.
36. Asa direct result of TOWER HILL’S breach of its insurance contract, MS.
BODNER was required to become obligated for attorney’s fees and costs in connection
with the prosecution of this action, and Florida Statute §627.428 provides for the payment
of attorney’s fees in the event of such need.
WHEREFORE, the Plaintiff, DONNA BODNER, prays this Court enter an award of
compensatory damages, consequential damages, pre-judgment interest, post judgment
interest, costs of this action, attorney fees; and such other and further relief as this Court
may deem just and proper.
DEMAND FOR JURY TRIAL
DONNA BODNER hereby requests a trial by jury on all issues so triable.

Deductible credits depend on your Coverage A (Dwelling
Structure Coverage) amount, your current deductible and your
home's location.
For example, an Orange County home with Coverage A equal to
$200,000, with a $1,000 All Other Perils deductible and 2%
Hurricane deductible could save 2.5% by changing to a
$1,000/5% deductible. For this home you could save as much as
14% by switching to a $2,500/5% deductible.
Selecting a higher deductible option will result in a premium
credit; however, in the event of a covered loss, you will be
responsible for higher out-of-pocket expenses. Conversely,
selecting a lower deductible will result in a higher premium,
though your out-of-pocket expenses would be lower in the event
of a covered loss.
Hurricane deductible changes can only be made at your policy
renewal. All Other Perils (AQP) deductible changes can be
made during the policy term. Please contact your agent for details
on other conditions that may apply.

IMPORTANT NOTICE ~ PLEASE READ CAREFULLY
The purpose of this Notice of Change in Policy Terms is to inform you of changes to the terms, coverages, duties
and/or conditions of your renewal policy as described below:
You may access a copy of your policy forms and endorsements through our secure Customer Login portal on
www.THIG.com.
if you have not already created an account on Customer Login, you will need the following information to register:
your policy number; agent iD; and Insured Location ZIP Code. This information is available both on your policy
declarations page and on your Tower Hill customer identification card,
The following provisions in the Special Provisions — Florida (HP-0109-09) form have changed:
The definitions for hovercraft, aircraft and drone have been added and the terms unoccupied and
vacant have been explicitly defined in your policy.
Your Reasonable Repairs provision has been revised to Reasonable Emergency Measures. In case
of a loss to covered property, you must take reasonable emergency measures solely to protect the
property from further damage and you may not exceed the greater of $3,000 or 1% of your Coverage
_ A limit to do so, unless you call us first and receive our approval. Please review Reasonable
Emergency Measures under Section | - Additional Coverages.
Coverage for damage by water. Please review Section | — Additional Coverages, Section | — Perils
Insured Against — Coverage A and Coverage B, Section | - Perils Insured Against - Coverage C and
Section /- Exclusions.
The Collapse provision in your policy has been revised, under Section | - Additional Coverages and
Section | - Perils Insured Against - Coverage A and Coverage B.
Your policy now excludes:
Property coverage for drones and water or steam under Coverage C — Property Not Covered,
Coverage for loss caused by: squirrels, ants, bats, bees and wasps, under Section /— Perils Insured
Against — Coverage A and Coverage B.
Coverage for damage caused by rain, snow, sleet, sand or dust to the interior of a bullding unless a
covered peril first damages the building causing an opening, under Section | — Perils Insured Against
— Coverage A and Coverage B and Section | ~ Perils Insured Against — Coverage C.
Coverage for bodily injury or property damage arising out of ownership, maintenance, use, loading of
a drone or hovercraft, under Section 1 - Exclusions.
Your policy Conditions have been revised:
Under Duties After Loss, your policy requires that you give us, or your insurance agent, prompt
notification of the loss. Please note, except for reasonable emergency measures under Additional
Coverages, there is no coverage for repairs that begin before the earlier of: (a) 72 hours after we are
notified of the loss, (b) the time of loss inspection by us, or (c) the time of other approval by us.
Under Loss Settlement, a statement has been added that allows us to exercise our right to repair
damaged property. The provision regarding not requiring advance payments for repairs and expenses
has been removed.
Under Mediation Or Appraisal and Suit Against Us, your policy now includes the requirement that if
you and we fail to agree on a settlement, scope of repair, or method of repalr regarding the loss, you
must notify us of your disagreement in writing prior to filing a suit.
Under Our Option, the options which we, as your insurance company, have when settling a claim
have been expanded.
Under Subrogation, all rights of recovery against any person or entity for your damages are
automatically transferred to us upon our payment to you under any coverage of this policy.
The following provisions in the Catastrophic Ground Cover Collapse (IL-0503-00) Endorsement have
changed:

The descriptions in this notice are intended to be for informational purposes only. Please review your policy and
endorsement language carefully. In the event of a conflict, the language in your policy and its endorsements will
be controlling.

applicable, your mortgage company will receive the renewal offer and make payment on your behalf. Our receipt
of the premium payment for the renewal policy is deemed to be your acceptance of the new policy terms.

1. Perform any and all necessary services to mitigate and or restore the property at the address listed above.
Provide a detailed BILL to be submitted to the INSURANCE COMPANY named above. If client has no insurance
company then BILL will be submitted directly to client/owner.
3. Deal Direct with the ADJUSTER representing the INSURANCE COMPANY on any and all issues of scope and
Price.
NTAN:
1. Undertakes to provide access to the property and grants SAFEWAY RES’
the restoration work.
P 2. Authorizes direct payment by the INSURANCE COMPANY to SAFEWAY RESTORATION LLC for all services
rendered.
3. Undertakes to cooperate with SAFEWAY RESTORATION LLC to ensure that payment is made by the INSURANCE
COMPANY immediately upon completion of the work. Should the Client’s Insurance Company fail to honor this
agreement, the Client will pay SAF} EWAY RESTORATION LLC any balance due within fifteen (15) days of Client’s
receipt of invoice. It is understood that the Client is personally responsible for any and all deductibles, charges, or
costs not covered by their insurance company. Payments received after 30 days are subject to a penalty of 1 1/2% per
month, If this account is placed for collection.
Declares that he/she is the owner of the property at which work will be performed or that he/she is the owner’s
representative legally authorized to contract such work.
Allows and instructs SAFEWAY RESTORATION LLC to disinfect, antisepticize, cleanse, decontaminate, deodorize,
fumigate, purify, sanitize, and sterilize any of the premises. The Client understands that it is beyond the expertise of
Safeway Restoration LLC to determine if someone is sensitive to their application and will hold Safeway Restoration
LLC harmless for their use,
ASSIGNMENT OF INSURANCE BENEFITS ONLY PERTAINING TO
‘THE UNPAID BALANCE DUE ON THIS CONTRACT
Client/Insured hereby assigns to SAFEWAY RESTORATION LLC any and all insurance proceeds and all other bencfits
and rights pertaining to the restoration service performed to mitigate/restore the property at the address listed above.
Including the right to recover attorney's fees and costs from my insurance company pursuant to Florida State Law and
this contract for any unpaid portion of this contract. Client/Insured hereby directs his/her insurance carrier to release any
