COMPLAINT COMES NOW the Plaintiff, REMYFORD RESTORATION SERVICES, LLC dba APEX DISASTER SPECIALISTS, a Florida Limited Liability Company, a/a/o Dustin Johnson (hereinafter “Plaintiff’), individually, by and through undersigned counsel and sues the Defendant, FEDNAT INSURANCE COMPANY, a Florida Corporation (hereinafter “Defendant”), and alleges as follows: 1. At all material times hereto, Plaintiff was and is a Florida Limited Liability Company licensed to transact business in Bay County, Florida. 2. At all material times hereto, Defendant was a corporation duly licensed to transact insurance business in the State of Florida. Defendant does business, has offices, and/or maintained agents for the transaction of its customary business in Bay County, Florida. 3. Jurisdiction and venue are proper in Bay County, Florida. Page 1 of 4COUNT 1 - BREACH OF CONTRACT 4. This is an action for breach of contract in excess of $15,000.00, exclusive of interest, costs, and attorney’s fees. 5. Plaintiff brings this action as an Assignee (hereinafter also referred to as “Assignee”) of Dustin Johnson (hereinafter “Assignor”). The Assignment has been attached hereto as Exhibit A. 6. Assignor sought homeowner’s insurance from Defendant to cover a dwelling. A policy of homeowner’s insurance (hereinafter the “Policy”) including, but not limited to, coverage to protect against wind damage, was issued by the Defendant in the State of Florida. 7. On or about October 10, 2018, Assignor’s dwelling at 100 Shoreview Drive, Panama City, FL 32404 (hereinafter the “Property”) sustained wind damage. 8. Plaintiff agreed to provide necessary remediation and repair services for Assignor, and in exchange, Assignor agreed to assign post-loss benefits for services rendered under the subject Policy to Plaintiff. 9. Plaintiff has submitted a reasonably priced bill to the Defendant for the services rendered, attached hereto as Exhibit B. 10. _ Plaintiff has not been paid in full by Defendant. This is an action related to Defendant’s failure to pay full value for the services set forth above. 11. Assignor’s Policy with Defendant was in full force and effect as to Assignor and the insured Property when the Property was damaged, and Assignor is named Insured under Policy No. FE-0000756085-02. A true and correct copy of the Policy is in the exclusive control of Defendant and has been requested through discovery. Page 2 of 412. Plaintiff has complied with all conditions precedent to be entitled to recover under the Policy, or the conditions have been waived. 13. Despite demand for payment, Defendant has failed or refused to fully pay Plaintiff's bill. 14. Defendant’s refusal to reimburse Plaintiff adequately for the services rendered, and to otherwise make Plaintiff whole, is a breach of contract. 15. As a direct and proximate cause of Defendant’s breach, Plaintiff has suffered, and continues to suffer, damages, including but not limited to, adequate compensation for services rendered, insurance proceeds that have not been paid, interest, costs, and attorney’s fees. 16. As a result of Defendant’s breach of contract, it has become necessary that Plaintiff retain the services of the undersigned attorney. Plaintiff is obligated to pay a reasonable fee for the undersigned attorney’s services in bringing this action, plus necessary costs. 17. Pursuant to Fla. Stat. § 627.428, Plaintiff is entitled to recover attorney’s fees and costs incurred in this action from Defendant. 18. Plaintiff seeks a contingency fee multiplier pursuant to the factors set forth in Florida Patient’s Compensation Fund v. Rowe, 472 So. 2d 1145 (Fla. 1985): 1) the relevant market requires a contingency fee multiplier to obtain competent counsel; 2) the undersigned was not unable to mitigate the risk of loss; 3) based on the amount involved, the results obtained, the contingency fee arrangement between the undersigned and Plaintiff, and the likelihood of success at the outset, Plaintiff is entitled to a 2.5 fee multiplier.
