ORDER TERMINATING DEFENDANT’S CONDITIONAL RELEASE
THIS CAUSE coming before the court upon a status hearing on September 8, 2021, regarding
Defendant’s continued compliance with treatment and status of her Conditional Release (CR) plan, ordered
on November 6, 2019. At the hearing, the Court reviewed the competency evaluation from Dr. Culver,
licensed psychologist, dated July 20, 2021. The parties stipulated to the report and the Defendant testified
that she has been attending her scheduled appointments and remains compliant with her medication
regimen. The Court adopts Dr. Culver’s report, finding Defendant incompetent to proceed and non-
restorable. Due to the non-restorable factor, the Court grant’s Defendant’s oral motion to terminate
Defendant’s CR plan.
As such, and in accordance with Schofield v. Judd, 268 So.3d 890 (Fla. 2d DCA 2019), the
Defendant is released from her Conditional Release plan, and should continue to maintain her medication
compliance and treatment with her current medical practitioner(s).
Accordingly, it is hereby
ORDERED AND ADJUDGED that pursuant to Schofield v. Judd, the Defendant herein is
released from all previously ordered conditional release plan requirements and all conditions of
release. Salus Care is no longer required to supervise the Defendant’s Conditional Release plan. The Court
will address dismissal of charges pursuant to FI. Stat. 916.145 when conditions precedent have been met.
