Deputy Chief Administrative Judge District Executive Courts Outside New York City November 8, 2021 Re: Alternative Dispute Resolution of Medical/Dental/Podiatric Cases on Trial Calendar Dear Medical Malpractice Bar, On October 19, 2021, Acting Administrative Judge of the 10th JD Nassau Judge Vito M. DeStefano, Judge R. Bruce Cozzens and myself met with members of the Nassau County Bar Association Medical-Legal Committee. The purpose of such meeting was to discuss how we can together address the 400+ medical malpractice cases currently awaiting trial in this District. In addition to the medical malpractice cases awaiting trial, there are more than 1700 other civil cases also awaiting trial. At this time, the Supreme Court is permitted to have no more than 4 trials proceeding on any day. In view of these safety restrictions, it is clear that Alternative Dispute Resolution is a vital and practical tool you must consider, if you wish to have your cases resolved during these unprecedented times. The Court is cognizant of the fact that not all cases are suitable for ADR, for this reason the Court is asking you, the party with knowledge and expertise over your case, to identify all cases you believe a dedicated Judicial Settlement Conference may lead to resolution. For instance, we ask you to identify cases in which there are not multiple defendants involved or where an institutional defendant is involved. Then, consider whether settlement of these cases is possible currently. We would also encourage you to determine whether there are extraneous/unnecessary parties named in the case that may be removed to facilitate settlement discussions with the remaining parties. Finally, cases that are being tried for a second time or where trial is limited in scope, may be particularly suitable for settlement discussions at this time. The Court will initiate the discussion and assign an In-house Mediator once you provide the above information. The Court will also be identifying appropriate cases for settlement conferences and calendaring such cases. You may of course attempt to resolve your case with co-counsel on your own, or with the assistance of a private mediator or arbitrator.
