YUEN HSIANG LU, being duly sworn, deposes and says:
1. I am the father of Wen Mei Lu, Li Hua Lu, Wen Ying Gamba and Wen Fu Lu. Chin Chung Lu is
my ex-wife. I divorced Chin Chung Lu in 1987, I am also a defendant in the above referenced matter.

2. I make this affidavit in opposition to cross-motion for summary judgment.
3. I have testified on two prior occasions in this case and submit this affidavit to supplement my
previous testimony.
4. Prior to April 2015, my daughter Wen Mei Lu held a power of attorney on my behalf. She was
given this power of attorney to collect rent from two restaurants I owned in Saratoga, New York.

5. Pursuant to our agreement, Wen Mei Lu was to deposit the funds collected from these properties
into bank accounts for me. I never agreed at any point in time to share the proceeds collected from these
properties with Wen Mei Lu. Pursuant to our agreement, Wen Mei Lu was simply to deposit the funds
in an account for me. Instead, she apparently deposited the funds into a joint bank account.
6, It came to my attention that Wen Mei Lu deposited the funds into various joint bank accounts
where she was also named as an account holder. In or around April 2015, Wen Mei Lu withdrew
approximately $83,167.96 from these accounts without my approval or conscñt and took the entire
amount for her own use.
7. In addition, it came to my attention that Wen Mei Lu had opened several bank accounts as joint
accounts with Citizens Bank. I did not authorize Wen Mei Lu to place herself on these accounts which
contained proceeds from the Saratoga properties. I never agreed to give any of these funds to her. Our
agreement was that she would deposit allthe funds from the properties into an account for me. Instead,
she deposited the funds into joint accounts.
8. Pursuant to a Power of Attorney with Wen Ying Gamba, I authorized the withdrawal of
these funds from the Citizens Bank accounts in the approximate amount of $94,265,03.
9. In including herself as an account holder on these accounts, Wen Mei Lu violated her
agreement with me to deposit the funds in an accoüñt for me. I never authorized or permitted her to take
possession of any portion of these funds.
