Claim arose on August 19, 2013, when the claimant’s incompetent was admitted
to Upstate University Hospital.
5 State substance of claim:
The defendants, their agents, servants, and employees, were negligent in the
medical and diagnostic care and treatment rendered to the claimant’s incompetent, PABLO
ENRIQUE UMANA FONSECA, using improper and inappropriate techniques in performing
the central venous catheterization procedure, placing the central venous catheter into the
patient’s right femoral artery and critically delaying the proper and appropriate diagnosis and
removal of the improperly inserted central venous catheter, causing, permitting, and allowing
the patient’s leg to become ischemic and causing, permitting, and allowing the patient to lose
his right leg above the knee.
