PROMISSORY NOTE
{INTEREST ONLY INSTALLMENT)
1, FOR VALUE RECEIVED, DAVID HYMES (hereinafter referred to as “Debtor’)
Jointly. and-severally agree to pay to the order of KAREN ADDIEGO (hereinafter “Creditor”) the
sum’ of -Fifty-Seven Thousand Dollars ($57,000.00) (“Principal”) in monthly interest only
installment payments beginning December 4, 2009, and continuing at the rate of one-half
percent (1/2 %) per annum.
2 The monthly interest only installment payments shall commence on December 1,
2009, and shail be paid in monthly interest only installment payments of Twenty-Three Dollars
and Seventy-Five Cents ($23.75) per month until the death of DAVID HYMES, at which date the
entire balance of unpaid Principal and interest shall be due and payable, without further act or
notice,
3. Debtor shall be in default and Creditor may, consequently, accelerate the
maturity of this note, making the total unpaid balance of the Note due immediately without
presentment for payment, demand or any notice, if: .
(A) Debtor or any endorser, surety or guarantor of this Note:
eae on i) Suspends business;
(ii) Becomes insolvent or offers settlement to any creditors;
(i) Files a petition in bankruptcy, either voluntary or involuntary;
(iv) Institutes any proceeding under any bankruptcy or insolvency
. laws relating to the relief of debtors;
, (v) Makes an assignment for the benefit of creditors;
(vi) Fails to pay any obligation when due;
(vil). Dies;.or
(B) Any legal action is taken against Debtor or any endorser, surety, or
guarantor, including:
(i) Entry of judgment.
(i) Issuance of a writ of attachment, order of garnishment, order or
subpoena in supplementary proceedings, execution, or similar process; or
(C) A receiver Is appointed for Debtor or any endorser, surety or guarantor.
4, Debtor agrees to pay all expenses incurred in any attempt to enforce this Note.
4lta Be Debtor agrees that if any legal action is taken to enforce this Note, the prevailing
party.will be entitled to reasonable attorney's fees in addition to any other relief that party may
be entitled to. This provision is applicable to the entire Note. :
6... Jurisdiction and venue for any action brought hereon shall be in the City and
County of San Francisco, State of California. :
7. Each party to this Note, including the Debtor and any endorser, surety, or
guarantor, waives the right to trial by jury in any action in connection with this Note.
8. This Note shall be governed by the laws of the State ‘of California, and if any
term, right or condition herein shall be invalid, in whole or in part, under said laws for any
reason, it shall not affect the validity of any other term, right or condition.
- 9 The undersigned agrees that the delivery of this Note to the Creditor is
unconditional and that the liability of Debtor is absolute and unconditional without regard fo the
liability of any other party. In addition, the Creditor herein shall have the right at any time or

10. This note may be prepaid at any time without penalty.
