Court convenes in Courtroom 1 with the above counsel and parties, outside the presence of the jury. Mr. Zimmerman indicates after meeting and conferring counsel agree to everything with the exception of one deposition clip, Mr. Laird intends to play in his power point presentation during opening statements. Counsel are heard in argument. The Court will not allow the clip to be presented during opening statements and directs counsel not to make any reference to that testimony. 8:41 am. The jury is conducted into the courtroom and appropriately seated. The Court welcomes the jury. Juror # 6 requests to move seats. The Court switches the seats of jurors #6 and #7, not their juror #, just their physical seat. 8:43 am. Mr. Laird presents opening statements on behalf of his clients. 9:52 am. Mr. Zimmerman objects and requests to approach the bench regarding continuing objections. The Court admonishes and excuses the jury for recess. 9:53 am. Court remains in session with counsel and parties present. Court reminds counsel, opening statements are not evidence and should be used as a roadmap as to what the evidence will show only. Mr. Zimmerman presents opening statements on behalf of the defendant. 11:28 am. Mr. Laird calls his first witness on behalf of his client. Witness Linda Reynolds 11:59 am. Mr. Zimmerman objects to the form of the question. The jury is admonished and excused for the luncheon recess and directed to return at 1:30 pm. Ms. Reynolds is excused for the luncheon recess. Court and counsel are briefly heard regarding scheduling. The Court directs counsel to return at 1:20 pm, to address counsel s objection. 12:01 pm. Recess. 1:21 pm. Reconvening with the above counsel and parties, outside the presence of the jury. Counsel are heard in argument. The Court requests the court reporter read back the last question asked. Mr. Laird will withdraw his question. Court sustains the objection and will allow the question to be withdrawn. Counsel’s motion to strike is granted. 1:26 pm. The jury is conducted into the courtroom and appropriately seated. Mr. Laird resumes direct examination of Ms. Reynolds.
