         states that information has been received that Alternate #2 is ill, and will not be present today. The Court finds
         a hardship for Alternate #2, and inquires if there are any objections. No objections by counsel. The Court
         excuses Alternate #2.

         8:37 a.m. Court reconvenes with counsel, parties, and jury present. The Court states that Alternate #2 has
         been excused due to illness.

         Marko Gutierrez is sworn and testifies.

         10:01 a.m. The Court admonishes the jury and takes a recess.
