Plaintiff, by the undersigned Attorney, alleges:
1. Plaintiff is a corporation licensed to conduct business in New York, with a principal place of
business at 3865 Route 11, Cortland, County of Cortland, State of New York.
2. That upon information and belief, the defendant, is an individual with a place of resides at
2856 Becker Rd Skaneateles, NY 13152.
3. This is an action for breach of contract arising from defendant's defâült in payment for
materials supplied by plaintiff and purchased by defendant.
4. That there is due and owing to the plaintiff by Defendant(s), the sum of $1,178.84 plus interest
at the rate of 9.000% from September 6, 2021, by reason of the Defendant(s) default in the payment for
goods and/or services provided by the plaintiff to the defendant.
5. The amount set forth in paragraph (4) above represents an account stated based upon regular
billing for goods and/or services provided to the defe-knt by the plaintiff without an objection thereto.
6. That although payment has been demanded of the Defendmt(s) by the Plaintiff, such has been
neglected and refused and/or denied. Plaintiff has been damaged in the total amount of ONE
THOUSAND ONE HUNDRED SEVENTY EIGHT AND 84/100 DOLLARS ($1,178.84) plus future
interest on the principal balance from September 6, 2021.
WHEREFORE, Plaintiff demands judgment against the Defendant(s), in the amount of ONE
THOUSAND ONE HUNDRED SEVENTY EIGHT AND 84/100 DOLLARS ($1,178.84) plus interest
at the rate of 9.000% reasonable attorney fees, if provided by contract and allowed by law together with
the costs and disbursements of this action, and whatever additional reliefthe Court deems just, proper and
equitable.
