You are advised to check the photos again. Your corian counter was the wrong length (too short), the wrong
width (too narrow), had cutouts in the wrong location, and was incorrectly field seamed. As the photos show,
the three cabinets were fabricated so Poorly that they could not be pulled together.
With a short time until the store's Opening, and your inability to do anything in a timely manner, | mitigated the
damages by correcting your work. You are most certainly responsible to reimburse me for this.
Sal informed me that Red Mango absolutely still uses the stainless steel protectors.
Please re-read your emails. No one ever said that the extra space on either side of the roll-in unit is a health code
violation. The space is unattractive, unnecessary, and your mistake. | was assured, verbally and in writing that
the unit would be replaced with a wider one.
| never touched your gate. Your installers cut it. It is a code violation. It is your mistake which needs to be
corrected before there is an unfortunate incident not covered by insurance.
If indeed you "build to the layout received", please explain the 6" open space at the back line and the 31" gate at
the front line casework.
Your response does not address the stainless steel counter which is shorter that the cabinet that it covers. (again
- see photos) Did you build that to "the layout received" as well?
If doing nothing is your final position, this would be just another of your mistakes.

| have shared your emails with our management team and legal. We will be reimbursing you for the items
returned only because they can be reused (lights, shelving, Corian tops).
We have installed well over 100 stores Red Mango with the same millwork, specified by Red Mango, that we
provided your store. You chose to redo the millwork facing and Corian tops on your own. That is not our
responsibility and also voids the warranty on our millwork.
As far as the punch list, we will not be completing the items that you feel are ‘open’. Red Mango no longer
uses the stainless steel corner protectors. You happened to get some items that the corner protectors were
installed.
The additional space on both sides of your roll-in unit is not a health code violation. Most of the Red Mango
stores do have spacing on both sides of the roll-in unit.
On the front line, we sent all Red Mango specified items below (36” gate, 84” topping unit, 18” syrup cabinet
(filler) and a 60” POS). This equates to 198”. This is 16’ 6”. Your allegations are incorrect. Also, we never cut
the swing gate as we understand the ADA regulations. Any alteration of the millwork was done by you or
those you hired to do so.
We build to the layout we received below.

Many weeks have passed, so | Suggest that you review the 50 or so photos which were emailed to you on
March 7, 2012. These would be the same photos which Sharon Oliver phoned to discuss 3 weeks ago, and are

You do not need to check any caulking and/or sealing. The caulking that your truck-unloaders installed,
(representative example is photo dscf1 186), has already been painstakingly removed and then properly
reinstalled by JMA Contracting.
Realignment of your cabinet doors is unfortunately not possible. Instead of quality hinges with 3-point
adjustment, you regrettably use the cheaper, non-adjustable type. The one drawer works fine and does not
need adjustment. | am not sure what you mean by "seams", but if it where 2 cabinets meet - your truck-
unloaders did the best that they, or anyone else could do to fasten together improperly fabricated cabinets.
Caulking the joint, or seam is not an acceptable solution. You are directed to NOT caulk anything in my store.
You are correct; your punch list work does include furnishing and installing the missing stainless steel cabinet
protectors, shown to be absent in photo dscf 1185.
The following list includes the items which your latest email once again, does not address These deficiencies do
not appear to be self-correcting, and your work will remain substandard, incomplete and in one case -
illegal, until you address them properiy:
- some of your shelves are still the wrong size as in photo dscf1184 and need to be replaced.
~ time did not make the the stainless divider in photo 1187 any more vertical than it was when
you left it. Straightening the existing or replacing it with new are the only 2 options that | can
think of, but other than ignoring it, what is your solution?
- the doors on the toppings bar were chipped when you built them, when you shipped them, and

when you unloaded them into my store. The passage of time did not make the chips
disappear. They are still chipped as in photo dscf 1188 They cannot be filed, and the doors
still need to be replaced.
~ the cabinet in photo dscf1191 is still almost an inch from the wall. It still needs a filler piece
installed. Caulking a gap of this size is not an acceptable solution. Do NOT caulk this void.
- the grille in photo dscf1202 is still warped. It is a result of a design deficiency and It needs to
be replaced with a grille which has Proper reinforcing to prevent the warping.
~ the cabinet in photos 1205, 1206 and 1207 is too wide - or - the counter that covers it is too
narrow. One or the other needs to be replaced. Again, caulking is not
an acceptable solution to your design and fabrication issues. DO NOT caulk anything in my
store.
- the tailpiece is still missing from the topping bars refrigeration unit. | asked once before and
did not receive an answer - When did you order it?
As you know, my FOH is exactly 16'-7" wide. Everyone receiving this email participated in a pre-construction
conference call during which 16'-7" was reiterated by you, 3 or 4 times. That's 16'-7' clear, from tile to tile, not
from GWB to GWB.
As you also know, you sent 16'-2" of casework to (not) fill the 16'-7" back wall. | am still awaiting the agreed
upon solution of a replacement (wider) smoothie bar unit.
As you also know, you sent approximately 17' of casework to fill the 16'-7" front line. On site, your truck-
unloaders cut several inches in width from the gate. At present, my store does not have a 36" wide ADA
compliant opening and does not meet code. The opening which you left behind is less than 31" in width. The
reduced opening not only makes it more difficult to receive our deliveries, it is a violation of building, fire/safety
and handicap accessible codes. Because you claim that you are here to help - and before one of our
customers, or one of our competitors calls the building department, what solution do you propose to rectify this?
| have read and re-read your latest correspondence. Your less than subtle hint that you may not have the skills
necessary to complete your contractually outlined scope of work, that you may choose to abandon this project,
breach your contract and leave me to correct your substandard and illegal work, has been forwarded to my
legal counsel.
Kindly let me know by Wednesday, May 9 if you prefer that JMA Contracting or I, engage the services
of another company to properly complete your contractually outlined scope of work

Not all of it - 10 shelves in the cooler were replaced when yours failed final inspection. Both building and fire
agreed that 18" deep shelving narrowed the access too much. | replaced it with 14" - the way that it should
have been sent in the first place. The improper 18" was returned to you. You and Norlake are experts in the
cooler business. This could not Possibly come as a surprise.
Unless Sal objects, please make your check out to Red Mango. Red Mango can return my money to me,
since that was our original agreement.
Of greater concern is the fact that you make no mention of addressing your extensive punch list. It has been
almost 2 months since you were sent Photos; 6 weeks since you walked the store. Not a word. No tailpiece
for the toppings bar unit - we continue to drain it by hand. No stainless steel edge protectors for the
cabinets. The sides of the ice machine casework still extend past the counter and catch all the food materials
and liquids which drip over the edge, so nowit is delaminating. And a dozen other items of deficiency.
No contact; no plan, no date for replacement.
What would you do about this if you were me?

| understand from Sal, that Load King has been paid in full for their subcontracts with both me and with JMA
Contracting.
| understand that there was a verbal agreement with IMA concerning JMA performing some of Load King's
work. Initially, it was expected that JMA would issue a deductive change order for this work, but with no
account from which to deduct, | will advise JMA to bill you directly and expect that the agreement between
you two will be honored.
As you are aware, | also had expenses related to Load King's performance, including:
the $3,900.00 replacement front solid surface counter and laminate face
the $1,400.00 return of the duplicate lighting package
the +/- $800.00 return of improperly sized shelving
the value of any other items on the returned goods bill of lading.
As you know, Load King was paid before they even shipped. | have been out of pocket for these expnses for
some time now. Please advise when | can expect bothe me and JMA to be made whole.
Also please advise regarding the status of completing your remaining punch list items.

As you know, your millwork/equipment supplier/installer insisted upon 100% pre-payment in advance, and attempted to "hold us hostage"
by refusing to deliver their goods and services without 100% pre-payment. Thank you again for agreeing to act as escrow agent for some
of this supplier/installer’s funds.
You have been copied on all of my correspondences with this supplier/installer and as you know:
- the store is not complete
~ the punch list items are not rectified
- the supplier/installer has failed to reimburse me for over $6,900.00 in agreed upon expenses
- the supplier/installer has recently refused to correct their deficient materials and workmanship
~ perhaps requiring further investigation and inspections - their installation has likely left my
store in violation of building, safety, fire and accessibility codes.

- Development's notes on the "New Store Open Approval Checklist" have not been satisfied
and/or completed
There is no reason for you to continue to hold these funds and by way of this correspondence, | relieve you of your escrow/fiduciary
duties. This email, which will be printed and forwarded to you by certified mail, represents my demand for immediate return of the
$7,500.00 which you are holding.
| will consider the matter closed if the funds are returned within 48 hours of receipt of this email.

Understood. The pace of others is clearly out of our control. Losing out

interested. My initial numbers indicate that the location would need to
gross 700K per year. Assuming that is correct, what can be expected from
this mall? Comps with other malls may have some use; comps from this mall
in particular would be very useful. Any contacts with the other food
purveyors in the Galleria?

Just got a second and third, first hand eye-witness opinion on the mall
location and I
am much more enthusiastic about it.
Can we express our interest and put something in motion that will ensure
that between now and when you and I meet on site after the RM convention
in Vegas, that it will not be leased to others?
Also - are your travel plans set? Can you tell me which day/date that we
can meet at The Galleria? Originally we spoke of on or about April 18,
19, 20 and I planned to be available in Ft Lauderdale any/all of those
days. However, I may need to fly in and back on the same day and hope
that you can help me target the right date.
