THIS CAUSE having come before the Court upon Plaintiff’s Motion for Partial
Summary Judgment Quieting Tax Title and For Possession and Plaintiff’s Motion for Judgment
on the Pleadings to Quiet Tax Title, hearing on the matter having been held on Motion Calendar
on December 9, 2020, having been attended by Ilian Rashtanov, Esq., as counsel for Plaintiff,
Gian Ratnapala, Esq, in his capacity as a Court appointed guardian ad litem, and the Court having
reviewed the court file, heard argument of counsel and being further advised in the premises, it is
ORDERED AND ADJUDGED, as follows:
1 Title to the following described real property (“Property”):
Lot No. Six (6), Block No. Two (2) as shown by a plat of Long Beach
Colony, on file in Plat Book 7, Page 24, of the Public Records of Palm
Beach County, Florida, being part of a subdivision of Section 27, Township
41 South, Range 37 East,
PCN: 00-37-41-27-01-002-0060,
A/K/A 13788 US Highway 441 N, Canal Point, FL 33438 (“Property”).

is quieted pursuant to F.S. §65.081 and confirmed in Plaintiff, BIRSCEO LLC whose post office
address is 20533 BISCAYNE BLVD., STE 4-146, AVENTURA, FL 33180-1529, pursuant to a
tax deed (“Tax Deed”) being recorded in Official Records Book 31508 Page 0769, of the
Public Records of Palm Beach County, Florida.
2.Any and all cloud on Plaintiff’s title to the Property with respect to the Defendants, LORETTA
J. HENSON; UNKNOWN HEIR OF LORETTA J. PUGH; NKA ROBERT PUGH and
UNKNOWN OCCUPANTS NKA MICHELLE HENSON and HINTON H. PUGH and
LORETTA J. PUGH his/her/its/their unknown spouses, widows, widowers, heirs, estate,
devisees, beneficiaries, grantors, creditors, grantees, and all parties having or claiming by,
through, under or against any and ail persons claiming any right, title, interest, ciaim, iien, estate
or demand against the named Defendants in regard to the subject property, or relating to any
claim by these Defendants is hereby removed, extinguished, dissolved and cancelled.
3.The above Defendants and those parties claiming by, through, under, or against these

the above-described Property or against Plaintiff, except as provided in the preceding
paragraph.
4.All of the ownership right, title, and interest of the above Defendants and those parties

5.Fee simple title is hereby vested in Plaintiff as against those mentioned above.
6.The Court hereby expressly reserves jurisdiction as to the re-opening of the case against
dismissed, omitted or unknown parties.
7£Each party shall bear its own costs and attorney’s fees.
8.Gian Ratnapala, Esq., Guardian/Attorney/Administrator Ad Litem in this case is hereby
discharged from any further responsibility in this case. The Court finds that the fees of the
Guardian/Attorney/Administrator Ad Litem in the amount of $400.00 for time spent in the excess
of two hours are reasonable.
9 Plaintiff shall recover from Defendants possession of Property for which let writ of
