Plaintiff, by its undersigned attorneys, complaining of the Defendant(s), respectfully alleges that:
1. Plaintiff is an active foreign entity conducting business in the state of NY.
2. Upon information and belief, Defendant(s) reside or is employed in of the State of New York, County
of FRANKLIN; or that the Defendant(s) transacted business with within the jurisdiction and venue where this
action is brought in person or through an agent and that the instant cause of action arose out of said
transaction.
AS AND FOR A FIRST CAUSE OF ACTION
3. The Defendant(s) hereto entered into a Credit Agreement with Plaintiff‘s predecessor in interest, First
National Bank of Omaha, bearing account #XXXXXXXXXXXX1754 who charged off the debt on
02/26/2021.
4. Upon information and belief, Plaintiff’s predecessor in interest duly performed all conditions on its
part under the agreement.
5. The Plaintiff thereafter took by assignment all the rights, title and interest to receive the monies
due pursuant to and in accordance with the said agreement and is the legal assignee of the original
creditor.
6. Upon information and belief, Plaintiff advised Defendant, in writing, of said balance due and
demanding payment. No payment has been forthcoming.
7. Defendant(s) defaulted in payment and pursuant to the terms of the agreement now owe a balance
of $1,584.32 as of 2/26/2021, no part of which has been paid despite due demand therefore.
AS AND FOR A SECOND CAUSE OF ACTION
8. That heretofore, upon information and belief, Plaintiff’s predecessor in interest rendered to
Defendant(s) monthly, full and truth accounts of the indebtedness owing by the Defendant(s) as a result of
the above Agreement, in an amount as hereinabove set forth, which account statements were delivered to
and accepted without objection by the Defendant(s) resulting in an account stated in the sum of $1,584.32
as of 2/26/2021, no part of which has been paid despite due demand therefore.
WHEREFORE, Plaintiff demands judgment against Defendant(s) in the sum of $1,584.32, plus costs and
disbursements.

certifies that, to the best of their knowledge, information and belief, formed after an inquiry reasonable
under the circumstances, the presentation of the paper or the contentions therein are not frivolous as

not obtained through illegal conduct, and the matter was not obtained in violation of Part 1200. Rule 4.5

PLEASE TAKE NOTICE that the matter captioned above has been commenced as an

that they lack the computer hardware and/or scanner and/or internet connection or that they lack
(along with all employees subject to their direction) the operational knowledge to comply with e-

Parties not represented by an attorney: Unrepresented litigants are exempt from
efiling. They can serve and file documents in paper form and must be served with documents
