MOTION TO COMPEL THE STATE TO COMPLY WITH DISCOVERY The Defendant, moves this Honorable Court to compel the State to comply with cat discovery in accordance with Rule 3.220, Fla.R.Crim.P. As grounds in support of this Motion’, Defendant would show: , 1. On December 29, 2007 the Defendant was issued a summons charging him with Assault and Battery. 2. The Defendant filed a Notice of Appearance and Demand of Discovery on December 28, 2007. (See attached Notice of Appearance) 3. On January 28, 2008 the Defendant appeared at the Case Disposition and counsel requested Discovery from the State and was informed that the file was in South County, and thus Discovery was not ready. 4, As of the date of the filing of this notice the Defendant has not yet received Discovery. WHEREFORE, the Defendant respectfully requests that this Honorable Court require the State to comply with discovery pursuant to Rule 3.220, Fla.R.Crim.P. and disclose the statements of defendant and any expert statements or reports.
