DOCKET NO. NNI-CV18-6014674-S SUPERIOR COURT CONNECTICUT HOUSING FINANCE AUTHORITY J.D. OF NEW HAVEN VS. AT MERIDEN JAMES F. LUCAS III, ET AL JUNE 20, 2019 MOTION FOR DEFICIENCY JUDGMENT The plaintiff in the above-captioned matter represents as follows: 1. A judgment of strict foreclosure entered in this matter on April 15, 2019, and the court set June 17, 2019 as the law day for the defendant, JAMES F. LUCAS III, owner of the equity of redemption; 2. At the time of the entry of said judgment, the subject property was appraised at a value of $82,000.00, and the plaintiff's debt was found to be $99,941.69, attorney's fees of $2,950.00, plus appraisal fees of $600.00, and title search fee of $225.00 for a total of $103,716.69; 3. The said defendant owner failed to redeem on his law day, and no subsequent encumbrancers redeemed on their law day; 4. Title to the subject premises vested in the plaintiff on June 20, 2019; 5. On the basis of the foregoing valuation and the amount of the plaintiff's debt, the plaintiff has reason to believe that a deficiency exists in connection therewith. ORAL ARGUMENT REQUESTED TESTIMONY NOT REQUIRED WHEREFORE, the plaintiff moves that an evidentiary hearing be assigned in this matter, in order that a valuation be established for the subject property and a deficiency judgment be entered in accordance with said valuation.
