Liquor, LLC (the “defendant”) hereby moves this Court to enter summary judgment

as to Counts 1 (negligent) and (2) (recklessness) of the plaintiff, Thomas Bull’s (the
CHESHIRE, CONNECTICUT 06410
“plaintiff”) complaint, on the ground that there is no evidentiary basis to establish the
element of causation as it pertains to the defendant. The plaintiff claims that she was
injured in a vehicle accident, caused by the intoxication of the driver, Ryan
Capozziello, which the plaintiff alleges was caused by consumption of alcohol sold by
the defendant to Allison Loder, who in turn provided the alcohol to Ryan Capozziello.
POST OFFICE BOX 747
The alcohol that the defendant sold to Allison Loder was not consumed by Ryan
Capozziello, and thus the defendant’s actions were not a proximate cause of the
plaintiff’s injuries. Therefore, the defendant is entitled to summary judgment as a
ONE TOWN CENTER
matter of law.
The defendant submits the attached memorandum of law in further support of
its motion.
