 Motion of Plaintiff to Compel Exemplis, LLC to Provide Further Responses to Demand for Inspection of
 Documents
 (First Set) and for Monetary Sanctions.
 Following the Informal Discovery Conferences held by this Court with the parties on 14 and 18 November,
 2021, it
 seems that plaintiff is demanding full compliance with Request for Production #7 without having limited the
 scope of the request
 any further.
 This Court understands the contention of plaintiff that defendants have failed to provide a further response
 to Request
 for Production #7 but is still not clear on any contentions of plaintiff as to what documents are missing that
 are otherwise

No formal tentative ruling was posted. The parties were requested to follow the Tentative Ruling Protocol if
they wish

to appear and argue the matter on the merits or deem the matter to be submitted on the papers. The matter
was duly noticed for a hearing. Messrs. Mollica and Olives appeared for the Plaintiff. Ms. Chow appeared for
the defendant Exemplis. Mr. DiMaria appeared for Defendants Spot On Consulting Group and Kelly Pauline
Playle.
Peter Ching, General Counsel for defendant Exemplis, LLC, declares that, in response to the requests, this
defendant
produced nearly 3500 pages of documents and ESI in response to the requests.
This Court reiterated its belief that asking Exemplis for all documents secured by the litigation hold may
include
attorney work product.
The parties seemed to reach an agreement that the documents requested in RFP #7 would be limited to a six-
month
period of time preceding 7 February 2020 and up to and including that date, limited to the identified
individuals, and limited to the incident giving rise to this lawsuit.
Responding party is to prepare a new privilege log for any documents withheld by a claim of privilege.
Responsive
production is due within 30 days of the filing and service of this order. No sanctions will be awarded as both
sides acted with substantial justification.
