SUPPLEMENTAL JUDGMENT — FORECLOSURE BY SALE
A decree of foreclosure by sale having been rendered in this action on March 27, 2017
and the case having come to the present time for the rendering of a supplemental judgment, and
the appearing parties having again appeared and been fully heard, no exception to the appraisal
or report of sale having been filed, this Court finds that the mortgaged premises described in said
decree were not redeemed from said mortgage, and have been sold by Jeffrey B. Sienkiewicz,
appointed for that purpose to sell the same, and that they have executed and submitted for
approval of this Court a conveyance of said premises to U.S. Bank National Association,
Trustee for Banc of America Funding 2009-FT1 Trust, Mortgage Pass-Through Certificates,
Series 2009-FT1, but have brought into Court none of the proceeds of said sale, the sales price
for said premises of $68,406.29, being less than the plaintiff's judgment debt, interest and costs,
and made return of their doings, on file; that the appraiser has appraised said premises under
oath and made return of such appraisal to the Clerk of this Court, as on file; all of which has been
done, pursuant to said decree.
The Court further finds that the expenses of the sale were found to be as follows:
Court awarded Committee Fees to Jeffrey B. Sienkiewicz $2,625.00
Court awarded Committee Expenses to Jeffrey B. Sienkiewicz $1,170.73
Court awarded Appraiser Fee to Jeffrey B. Sienkiewicz $350.00
TOTAL EXPENSES OF SALE $4,145.73
The Court further finds that there is due at this time from the defendants to the plaintiff in
this action, upon the property being foreclosed, the sum of $68,433.28, which is broken down as
follows:
Judgment Debt of March 27, 2017 $52,705.47
Interest from day after judgment through sale
date at 5.74% (March 28, 2017 through July 1, 2017) $703.68
Court awarded counsel fees $1,700.00
Comunittee fees / costs $4,145.73
Bill of Costs $1,251.63
Taxes Paid $5,124.77
Property Preservation $1,320.00
Hazard Insurance $1,482.00
TOTAL $68,433.28
The Court further finds that the defendants, Theodore B. Mulle and Denise D. Mulle, are
in possession of said premises.
Whereupon, it is adjudged that the sale be and the same is hereby ratified and confirmed
and the conveyance approved; the defendants, Theodore B. Mulle and Denise D, Mulle, shall
deliver up the premises to said purchaser, and that the Plaintiff has paid in full the expenses of
said sale to the persons to who they are hereinbefore found have been due.
