October 19, 2021 DEFENDANT DAVID MASON’S OBJECTION TO PLAINTIFF’S MOTION FOR LEAVE TO FILE A THIRD AMENDED COMPLAINT Defendant David Philip Mason (“Mason”) hereby submits the following objection to the Plaintiff’s Motion for Leave to File a Third Amended Complaint (Entry No. 234.00). This would be the fourth complaint filed by the Plaintiff Nancy Burton (“Plaintiff”) in this matter. The Plaintiff’s prior and repeat amendments have caused unreasonable delay, mislead the parties, taken unfair advantage of the Defendants, and confused the issues because the amendments have forced Mason and the other Defendants to repeatedly amend and supplement their filings. Mason hereby incorporates and adopts the arguments set forth by any and all co-defendants in their respective Objections to the Plaintiff’s Motion for Leave to File a Third Amended Complaint. CONCLUSION Therefore, the Plaintiff Nancy Burton’s Motion for Leave to File a Third Amended Complaint should be denied. Defendant, DAVID P.
