   PLAINTIFF’S MOTION THAT COURT’S ORDER SET FORTH IN JDNO “175.00
      NOTICE” BE EXPANDED TO INCLUDE DEFENDANT SUSAN WINTERS


   Plaintiff moves herewith that the Court's “175.00 Notice” issued on August 30, 2021
be expanded to include Defendant Susan Winters. A copy of the Notice is attached
hereto. The Notice is directed to the Mason, Carmody and Gibbons defendants with
regard to discovery concerning their pending special motions to dismiss.
    On September 1, 2021, with the permission of the Court, Defendant Winters filed a
special motion to dismiss the Second Amended Complaint in which she raises issues
similar to those set forth in her co-defendants’ special motions to dismiss. Therefore, the
discovery being permitted with regard to the Mason, Carmody and Gibbons defendants
should also be permitted with regard to Ms. Winters.*

‘ Plaintiff readily and apologetically acknowledges her error and inadvertence in failing
to have Ms. Winters served with the summons and complaint as Plaintiff was unaware
of her change of address; nevertheless, Plaintiff will argue in her shortly-to-be-filed
objection to Ms. Winters’ motion to dismiss premised on lack of personal jurisdiction that
by appearing and participating in the case she has waived the issue.

   objections, if any, without the need for a good faith affidavit or briefing. The Mason, Carmody, and
   Gibbons defendants must then comply with the remaining interrogatories, if any, within 14 days of the
   court's ruling on the discovery objections. No further discovery will be permitted.
