SANTABENE, on or about March 26, 2006, did in this County violate Section 2903.06(A)(1) of the Ohio Revised Code in that she did while operating or participating in the operation of a motor vehicle, motorcycle, snowmobile, locomotive, watercraft or aircraft, did cause the death of Kimberly A. Ruyle, as a proximate result of committing an offense in Section 4511.19 (A) of the Ohio Revised Code or of a substantially equivalent municipal ordinance; contrary to the form of the statute (in violation of Section 2903.06(A)(1) of the Ohio Revised Code) in such case made and provided, and against the peace and dignity of the State of Ohio. SECOND COUNT: AND further, now comes Mathias H. Heck, Jr., the Prosecuting Attorney of Montgomery County, Ohio, says by way of information that the Defendant, JEANNIE L. SANTABENE, on or about March 26, 2006, did in this County violate Section 2903.08(A)(1) of the Ohio Revised Code in that she, while operating or participating in the operation of a motor vehicle, motorcycle, snowmobile, locomotive, watercraft, or aircraft, did cause serious physical harm to another person or another's unborn, to-wit: Kelly A.
