ORDER GRANTING PLAINTIFFS’ VERIFIED MOTION TO REINSTATE
THIS MATTER CAME ON FOR review on Plaintiffs’ Verified Motion to Reinstate. After
reviewing the Verified Motion to Reinstate and the exhibits attached thereto, and noting that
Defendants did not take a position on this Motion, the Court finds that Plaintiffs’ failure to respond
to the DWOP Notice or attend the DWOP hearing was not intentional or the result of conscious
indifference but was due to an accident or mistake or has otherwise been reasonably explained.
The Court additionally finds that Plaintiffs did not attend the DWOP hearing due a
misunderstanding concerning the status of the hearing following their receipt of an email
communication from the Court Coordinator.
Based on these findings, the Court Orders that this case be reinstated on the Court’s active
civil docket.
